Foreclosures are Increasing

Foreclosures are increasing.

According to several recent news articles and reports,  it appears that foreclosure actions are once again on the rise. Fortunately, we have noticed much of an increase in foreclosure actions being brought.  At any rate, this is still troubling news.

Loan Modifications are up.

At least in our office, we have seen an increase in Loan Modifications. Many of our clients have recently received loan modification offers. Many of the offers are for a HAMP trial modification. However, we have received some permanent in-house modification offers.

Each case varies:

  • Some cases involved lengthy litigation (years).
  • Some cases were resolved in a matter of months.
  • Several of our clients had already filed for chapter 7 bankruptcy
  • Most, if not all, of our clients were previously turned down for a loan modification.

Foreclosure Defense and Loan Modifications

Recently we have experienced an increase in the number of our clients receiving loan modifications.  These modifications are both HAMP and In-House, temporary and permanent.  The cause is unknown but for our clients, it doesn’t matter why.  They are just grateful that it is happening.  As the foreclosure world is still in shock with the announcement of the impending closing of Steven J. HUD launches a new website that will allow homeowners to conduct their own net present value (NPV) evaluation of their mortgage for the Home Affordable Modification Program (HAMP):

CheckMyNPV.com is a free tool provided by the United States Department of the Treasury, and the Department of Housing and Urban Development in conjunction with the Obama Administration’s
Making Home Affordable Program.

CheckMyNPV.com is designed to assist homeowners in conducting a net present value (NPV) evaluation of their mortgage for the Home Affordable Modification Program (HAMP).
Need more information about NPV?

CheckMyNPV.com can be used by homeowners who have been denied a HAMP modification because of their NPV result. Homeowners can enter the NPV input values listed in the HAMP Non-Approval Notice received from their mortgage servicer, or substitute with estimated NPV input values, to compare the outcome provided by CheckMyNPV.com against that on the Non-Approval Notice.

This tool can also be used by homeowners prior to applying for a HAMP modification to help them better understand the NPV evaluation.

CheckMyNPV.com provides only an estimate of a mortgage servicer’s NPV evaluation. While the NPV formula used on CheckMyNPV.com is required to be the same as that of your mortgage servicer’s, differences in input data and other industry-related data may result in different outputs. After using CheckMyNPV.com, it is recommended that you save a copy of the evaluation and share it with your mortgage servicer to discuss options available to you.

More Loan Modifications?

This year, much to our delight, several of our foreclosure defense clients have received acceptable loan modification offers from their respective lenders. What’s most pleasing is that these clients had been rejected, on several occasions for some,  or they were previously offered an unacceptable, unaffordable loan modification.

Last year, we found loan modifications hard to come by. In one case, we found serious problems with a major lender’s foreclosure paperwork. We requested a loan modification or dismissal of the foreclosure action with prejudice. However, rather than give our client a loan modification, the lender chose to discontinue their foreclosure action against him. Not a bad result at all, but our client really wanted a loan modification.  As of today, the lender has not restarted the foreclosure action and a loan modification is being considered.
