Here is a question that we have been asked lately:
Can I stop paying my rent if my landlord is facing foreclosure?
Probably not.
You are not justified in withholding rent that is due “solely” because you received a notice that your landlord is facing foreclosure.
Your landlord will be able to bring a landlord-tenant action against you for non-payment of rent. Your landlord may be able to recover possession of the premises and/or rent owed and attorney’s fees from you.
