DWI Issues and Long Island
DWI – Driving While Intoxicated aka Drinking and Driving. Drinking and Driving is a problem that has plagued Long Island. Nassau County and Suffolk County have a major problem with drunk drivers on their roads. There was an informative article in the New York Times on July 24, 2015 written by Kirk Semple, that caught my eye. Drinking and Driving has an impact on all Long Islanders. It is worth taking a minute to read this New York Times article if you have time.
Drinking While Intoxicated causes grief for the families of both the perpetrator and the victims. For the individual caught driving while intoxicated, attorneys fees, impound fees and facing criminal charges should be sufficient deterrents. For some reason, especially on Long Island, they have not deterred enough drivers from driving while intoxicated. For victims of DWI incidents, there are many consequences as well. Medical treatment, if they are lucky enough to survive, time investment for personal injury suit to be compensated for damages suffered, lost time from work and a myriad of other issues are often the results. As set forth in the article, Long Island is particularly hard hit by DWI incidents.

Foreclosures are Increasing
Foreclosures are increasing.
According to several recent news articles and reports, it appears that foreclosure actions are once again on the rise. Fortunately, we have noticed much of an increase in foreclosure actions being brought. At any rate, this is still troubling news.
Loan Modifications are up.
At least in our office, we have seen an increase in Loan Modifications. Many of our clients have recently received loan modification offers. Many of the offers are for a HAMP trial modification. However, we have received some permanent in-house modification offers.
Each case varies:
- Some cases involved lengthy litigation (years).
- Some cases were resolved in a matter of months.
- Several of our clients had already filed for chapter 7 bankruptcy
- Most, if not all, of our clients were previously turned down for a loan modification.

Marriage Equality Act (MEA)
Recently we have received several phone calls regarding the Marriage Equality Act. The Marriage Equality Act is the act which has changed the New York Domestic Relations Law to allow the parties to a marriage to be of the same sex.
This act also ensures that all benefits that are given to heterosexual married couples also be given to homosexual married couples; whether these benefits stem from legislation, common law, administrative or court rule, public policy or however else. This MEA has gone into effect as of July 24, 2011. In the Dickerson v. Thompson ruling, the Court points out the fact that The MEA also provides that valid out of state same sex marriages will be recognized and treated the same as valid in state marriages of any kind.
